1. company information

2. eligibility

You must be 18 years of age or older to use the Service. By using Zwyft, you confirm that you meet this requirement and have authority to enter into these Terms.

3. the service

Zwyft allows users to purchase and send digital gift cards to other users through Apple iMessage. Gift cards are offered for select merchants operating in the United States and Canada.

Zwyft does not issue or redeem gift cards. All gift cards are issued and redeemed by third-party merchants and are subject to the merchant's own terms and conditions. You are responsible for reviewing those terms before purchase or redemption.

4. payments and fees

• All purchases are processed through Apple Pay.
• A flat service fee of $0.99 is added to each transaction and clearly displayed before checkout.
• All sales are final. Once a gift card is purchased, it cannot be refunded or canceled except as described in Section 8.

5. delivery and use

Gift cards are delivered electronically via iMessage. By using the Service, you acknowledge that:

• You are responsible for selecting the correct gift card and recipient.
• Delivery relies on Apple services, including iMessage and Apple ID.
• Gift cards may have expiration dates or usage limits set by the merchant.

6. user responsibility

Zwyft is not responsible for issues resulting from:

• Sending a gift card to the wrong recipient
• iMessage delivery delays or failures
• Merchant refusal or limitations on redemption
• Loss, deletion, theft, or misuse of a gift card after delivery

Once delivered, a gift card is considered used for the purposes of these Terms.

7. acceptable use and account access

You agree not to misuse the Service, including engaging in fraud, abuse, or unlawful activity.

Zwyft may suspend or restrict access to the Service where reasonably necessary to protect users, comply with legal obligations, or prevent fraud or abuse.

8. limited liability and refunds

To the fullest extent permitted by law:

• Zwyft is not liable for indirect, incidental, or consequential damages.
• If a purchase fails due to a technical error directly caused by Zwyft, our total liability is limited to a refund of the amount paid for the gift card plus the $0.99 service fee.
• No refund is available for user error, third-party system failures, or merchant actions.

9. privacy

Zwyft's data practices are described in our separate Privacy Policy, available on our website. Zwyft does not access payment credentials and receives only transaction tokens provided by Apple Pay.

10. governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

11. changes to these terms

We may update these Terms from time to time. Continued use of the Service after changes means you accept the updated Terms.
